Supreme Court Revives FBI's 2017 Wrong-House Raid Lawsuit

In a unanimous decision, the Supreme Court reinstated a lawsuit against the FBI for a 2017 raid in Atlanta, where agents mistakenly stormed Trina Martin's home, deploying a flashbang grenade and pointing guns at her family, including her 7-year-old son. The agents quickly apologized, attributing the mistake to a misdirected GPS.
The Court's ruling sends the case back to the 11th Circuit to determine if the Federal Tort Claims Act allows the lawsuit to proceed. Justice Neil Gorsuch emphasized that the federal government can be held liable under state law similarly to private individuals, stating, 'Congress has entered the field and expressly bound the federal government to accept liability under state tort law.'
The FBI agents, realizing their error, left the house after approximately five minutes, leaving behind a traumatized family and a damaged home.
